1. Introduction and Terms

1.1   These Terms and Conditions (Terms) should be read in conjunction with the Privacy Policy.

1.2   The website called www.chicylittlemonkeys.com belongs to The Borrowers Ltd.

1.3   By using the website www.chicylittlemonkeys.com, called “Website” you become a "User" of the Website and agree to be bound by these Terms.

1.4   The terms “Us”, “Our”, “We” and the “Company” refer to The Borrowers Ltd of the registered address 9 High St, Wellington TA21 8QT.  The Company includes any associated companies and all its employees, officers, Directors, partners, shareholders and affiliates.

1.5   The term “User” or “Users” refers to any person visiting, browsing, registering, searching, reading, communicating, selling to or purchasing from or interacting with the Website and/or the Company.

1.6   The terms “You” and “Your” refer to all Users of the website www.chicylittlemonkeys.com

1.7   The terms "Product" and "Products", "Garment" and "Garments", "Clothes" and "Clothing" refer to items displayed and sold on the website www.chicylittlemonkeys.com.

1.8   We have the right to make changes to these Terms and Conditions at any time and you should check these Terms on a regular basis. If you continue to use the Website after the changes have been made it will be regarded that you accept the amended Terms. If you do not agree to be bound by the Terms or changes to the Terms, you must cease to use the Website.

2. Using the Website

2.1   Unauthorised use of this Website may give rise to a claim for damages and/or be a criminal offence.

2.2   The Company does not act as an agent or representative of any person or company who provides Garments for sale on the Website or who advertises on the Website. 

2.3   Whilst the Company will do its utmost to be as accurate as possible, no warranty or representation is given that the information and materials contained on it are complete or free from errors or inaccuracies and the Company will not be responsible or liable for any loss, damage or expenses which may result from the use of the Website and its contents.

2.4   The Company will control the Website and reserves the right to amend the services, prices, site design and any other technical or commercial aspects of the site from time to time.

2.5   The Company will make every effort to ensure that the Website is available to visitors and registrants at all times. Downtime will be kept to a minimum but may be necessary from time to time to undertake maintenance work on the Website, however We do not accept any financial liability for any interruption in service or temporary loss of the Website.

2.6  Links from the Website to third party sites are provided for convenience only. The Company is not responsible for the content, accuracy or availability of the details provided on any third party site.

2.7  If you wish to make a complaint about the Website or the Company you should contact us by emailing  support@chicylittlemonkeys.com and provide as much information as possible.

2.8  Users must be over 18 years of age.

2.9  A User is responsible for the safe keeping of their username and password and should keep them confidential.  You should not use the Website on non-personal computers.  If a User does use the Website on a public computer they should ensure they log out once finished.

3.  Selling Clothing to the Company

3.1   We only buy and sell Clothing suitable for children between the ages of 12 months and 12 years.  No other Garments will be accepted, except at the discretion of the Company.

3.2   We only buy the types of clothing listed on the "Garments We Like" page of the Website.  No other Garments will be accepted.

3.3  We only buy the brands of clothing listed on the "Brands We Like" page of the Website.  No other Garments will be accepted.  This page will be updated as and when new brands are added to the list.

3.4   Garments sent to us by Users should be either:

  • Brand New With Tags  - this may or may not include the original price.
  • New Without Tags  - this can mean that the garment has either never been worn or worn no more than once or twice.
  • Barely Worn - the garment should show no sign of wear, damage or over-laundering. 

Every Garment should be free from any damage, odour and hair, should not be over-worn, over-laundered, stretched, pulled, faded, frayed (unless it's part of the design), stained or repaired and should not be homemade, fake or altered. 

From time to time, we receive Garments which may have slight pilling or minimal damage but which still have lots of wear left in them.  We may decide to offer these items for sale, however we will always add a "PLEASE NOTE" message in the product details, indicating the fault or damage.  Such items will command a lower selling and buying price than those falling into the three categories above and will be listed in the "With Slight Fault" category.

If we suspect any item to be a fake, the police and the design house that the Garment is purporting to be from will be advised and, if found to be fake, your details may be given to the appropriate authority if required to do so by law.

3.5   Once a bag of Garments is received by the Company, the User shall not request any items to be returned and will accept the amount offered by the Company for the qualifying garments as full and final settlement.  The Company has the right to refuse payment for any Garment if it believes it does not qualify and is unsuitable for selling.  Such Garments will be sent to our appointed charity or, if not good enough, will be sent to a recycling centre.  Qualifying Garments can be found in the lists on these two pages of the website:  "Brands We Like",  "Garments We Like".

3.6   If required by the User, the Company will provide an approximate quotation for Garments prior to them being sent to the Company, on the understanding that the User provides the Company with at least 2 photos (front and back) of each garment, the designer name, the size, condition and colour of each garment and, if possible, the original price paid.  Once the Company receives the goods and can examine them properly, the amount earned could either be more or less than the quoted price depending on the quality and/or condition.

3.7   The price paid for each garment will depend on the brand, its condition, the type of Garment and the Company's ability to sell it.  This is how We work out how much to pay you:

  • Each item will first of all be allocated to either Band A, B or C depending on the brand of the label. 
  • Next the condition is considered and whether the Garment falls into one of three categories: Brand New With Tags, New Without Tags, or Barely Worn. 
  • Then the approximate or actual original price is considered. 

From this information a selling price is established and consequently a buying price (ie, the amount the User earns).  The price We pay the User will be no less than 30% and no more than 50% of the resale value of each qualifying item.

3.8   We will write to confirm receipt of your bag on the day of receipt.  It will then take approximately 3 working days for the Company to process each garment for sale.  Once processed We will send a second email to advise how much has been earned and we will pay you the full amount within 2 working days.  We are unable to make your payment by any other method at this stage.

3.9   We will pay the postage for the collection bag which will allow up to 5kgs of clothes to be sent to Us.  The bag must be as full as possible with qualifying garments which can be sold. If the total selling value of the bag you send is less than £200, then we will deduct a £5 postage contribution from the amount we pay you. 

3.10   Any garment which does not qualify for sale on the Website will be either donated to CLIC Sargent or our appointed charity, or sent for recycling.  WE CANNOT RETURN GARMENTS ONCE WE HAVE RECEIVED THEM.

4.  Orders, Cancellations, Returns and Refunds

4.1   You can pay for orders using any of the credit or debit cards that we accept or Paypal. 

4.2  Orders placed via the Website will be despatched within 1-2 working days although this may not be possible at busy times.  Depending on the option chosen, goods will be sent either by:

  • Next day delivery
  • 1st class post (1-2 working days)  
  • 2nd class post (3-5 working days)

We do not guarantee these delivery times and cannot accept any liability if your goods do not arrive on time, unless this is caused by our negligence.

4.3   Postage and packaging prices are displayed on the website at the point of purchase.   They can also be found in the FAQ's.  

4.4  We do not deliver to BFPO addresses, to multiple addresses, PO boxes, or to any address outside the UK.

4.5  We reserve the right not to deliver an order if we believe the address is not secure, for example to a communal postal address or PO box.  If this affects an order you place, we'll notify you as soon as possible.

4.6   If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing by the 30th day to support@chicylittlemonkeys.com with "Order Query" in the subject.  Please provide us with your order number and your postcode together with the details of the Product(s) you have ordered and preferably forward your order confirmation email.  If you notify a problem to us under this condition, because all Products displayed on the Website are one-offs, our only obligation will be to either supply you with garment of the same value or to refund to you the amount paid by you for the goods in question.  No further compensation will be paid.

4.7   If your order arrives damaged, unless that damage has been described as a fault in the advert on the Website, or if the order arrives incomplete, please email support@chicylittlemonkeys.com within 7 working days of receipt, with "Order Query" in the subject.  Please provide us with your order number and your postcode together with the details of the Product(s) you have ordered.

4.8   In accordance with Distance Selling Regulations, you are entitled to cancel this contract if you so wish provided that you exercise your right by notifying us no longer than 7 working days after the day on which you receive the Products.  If you wish to exercise your right to cancel this contract after your order has already been despatched, we will refund the original purchase price but not the delivery cost, provided that you have notified us in writing no longer than 7 working days after the day on which you place the order.  Our labels should be attached, the Products should not have not been used and you must return the Products.  Your cancellation rights will end after seven working days counting from the day after the day this contract was agreed.

4.9   If the Product doesn't fit or isn't quite right you can return it us for a full refund so long as it still has our labels attached and hasn't been worn.  You must return the goods within 10 working days of receipt.  We cannot refund your postage costs.

To return an item:

  1. Log into your account and select Completed Orders.
  2. Click on the "Return Item" button.
  3. On the next screen select the product you want to return and choose the Return Reason.
  4. Click on Submit Return Request.
  5. Wait to receive our acknowledgement email and follow the instructions given in the message. 

We strongly recommend that you send the parcel RECORDED DELIVERY or by some means of tracking.

We'll send you an acknowledgement email as soon as we have received the item and will confirm when the refund has been processed.  

4.10   We can only refund the postage if the Product you receive is either the wrong garment, or has a fault that is not described in the advert.

4.11   If any part of these Terms and Conditions is breached, the Company reserves the right to cancel this agreement immediately without course for a refund and without incurring any liability to the Company.

4.12  No refund will be made for loss of Internet service.

4.13  Under no circumstances will a refund ever exceed the value of the amount paid for Products, either for the buying or selling of such items.

5. Limit of Liability

5.1 The maximum liability for any loss arising due to negligence on the part of the Company will be limited to a sum equal to either the value of the sum paid for Garments received by the Company from a User, or the value of the sum a User has paid for their latest order placed on the Website.

6. Security

6.1  The Borrowers Ltd is registered with the Data Commissioner under the Data Protection Act 1998 and complies with the Act with regard to the safe storage and use of your personal details.

6.2   The Company takes every possible step to ensure the security of the Website and its content, personal details, messages and adverts. Users of the Website should ensure they have their own security protection.  We take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

6.3   The distributing, by Users, of viruses, spam, chain mail or other promotions is disallowed.  The Company cannot guarantee that its Users will comply with this condition. The Company will not be responsible or liable for such actions by its Users.

6.4   Any information supplied to the Company by its Users will not be divulged to any third party without the consent of the registrant, unless required to do so by law. Registrants to the website have the opportunity to opt in and out of any marketing preferences at any time by logging in to their account.

7. Intellectual Property and Copyright

7.1   This Website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these Terms and Conditions.

7.2   The domain name and website www.chicylittlemonkeys.com belongs to The Borrowers Ltd. All Users of the Website acknowledge and agree that all Intellectual Property Rights in and relating to the Company's logo, trademarks, designs and title shall be retained by The Borrowers Ltd.

7.3   Permission is given to download and print any of the adverts from the website for personal use only.  No part of the Website may be copied, transferred or stored on any other website without prior written consent.

7.4   No part of the Website can be reproduced for inclusion on any other website or in any other advertising campaign unless written consent has been given by The Borrowers Ltd.

8. Force Majeure 

8.1   The Company shall not be liable for any delay in or failure to perform its obligations if that delay or failure is caused by circumstances beyond its reasonable control, including without limitation fire, strikes, insurrection, malicious damage, compliance with any law or governmental order, riots, embargos, inability to obtain supplies, refusal or revocation of licence or regulations of any civil or military authority, act of god, flood, storm, industrial disputes or any network breach, breakdown in any Third Party equipment including Third Party computer hardware or software.

9. Severance

9.1   If any part of the Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms and shall not affect the validity and enforceability of any of the remaining provisions of the Terms.

10. Jurisdiction

10.1 This agreement and any dispute pertaining to it shall be subject to English Law.
